The Central Pollution Control Board (CPCB) has amended its guidelines regarding waste management regulations in India, introducing new provisions for used oil under the Extended Producer Responsibility (EPR) framework. Previously, EPR, also known as Extended Producer Responsibility, categorized waste into four categories. However, the recent amendment has added a new waste category specifically for used oil.

Under the revised EPR guidelines, used oil is now included in the responsibilities of manufacturers, importers, and recyclers. Consequently, EPR certification for used oil has become mandatory, and all manufacturers, importers, and recyclers must obtain EPR certification for their businesses from the CPCB or the State Pollution Control Boards (SPCB) respectively.

What is Used Oil? - Definition

The definition of used oil is outlined under Clause 3 of the Hazardous Waste Management Rules, 2016. "Used oil" refers to any derivative of crude oil or an oil mixture containing synthetic oil, which includes used engine oil, hydraulic oil, turbine oil, compressor oil, and industrial oil. However, any other oil specified in Part A of the Hazardous Waste Management Rules does not qualify as used oil unless it meets the criteria for waste/used oil specified in Part V of the Hazardous Waste Management Rules, 2016.

 Who Required EPR Registration for used Oil or Waste Oil:

Any entity involved in the manufacturing, production, or importation of used oil or industrial waste oil is eligible for EPR registration for used oils. The objective of implementing EPR for used oil is not only to manage the production of hazardous substances but also to promote an economically sustainable and environmentally friendly industry.

Entities Required to Obtain EPR for Used Oil:

  1. Producers
  2. Collection agents
  3. Recyclers
  4. Used oil importers

Documents Required for EPR Certification for Used Oil

Applicants must attach the following documents to obtain EPR certification for used oils:

  1. Address proof of the applicant
  2. Business registration certificate, as applicable
  3. PAN and GST details
  4. Import Export Code (IEC) certificate
  5. Manufacturing details (for manufacturers/producers)
  6. Details regarding the generation of used oil
  7. Import details of used oil (for importers)

Renewal & Return of Online EPR Registration

Manufacturers must submit a renewal application with all required documentation at least 60 days before the current registration expires. Producers are also required to file their annual returns by June 30th of the year following the registration period. Applications for renewal will not be processed until all required annual reports have been submitted.

EPR Targets for Used Oil

The EPR target for importers and producers of used oil or waste oil is assigned during the registration process. These targets specify the obligations for recycling waste oil within a given timeframe. Producers and importers are required to meet their EPR obligations as per the preassigned targets.
